Complaints procedure

We always strive to provide you with the best possible service and our policy is always to be ready to discuss any points of concern with our clients so that we can do our best to resolve any such issues.

If at any stage you are unhappy with or have concerns about the service Winter & Co is providing to you or the level of Winter & Co's charges, it would be helpful if, in the first instance, you could raise your concerns with the Responsible Lawyer.

If the Responsible Lawyer is not a Partner, and you would prefer, for any reason whatsoever, to discuss any aspect of the Matter, or any concern about Winter & Co's service, with a Partner, you should contact the Supervising Partner or Winter & Co's senior partner, Glenn Winter.

If we are unable to resolve your concerns with you, you are entitled to make a formal complaint which will be dealt with in accordance with our Complaints Procedure, a copy of which is available for inspection at our offices or on request.

If we cannot resolve your complaint through our Complaints Procedure, you may be able to ask the Legal Ombudsman to consider your complaint. They will look at your complaint independently and it will not affect how we handle your Matter.

Before accepting a complaint for investigation, the Legal Ombudsman will check that you have first tried to resolve it. If you have then you must take your complaint to the Legal Ombudsman within six months of receiving a final response from us to your complaint and no more than six years from the date of the relevant act/omission or no more than three years from when you reasonably should have known there was cause for complaint.

If you have concerns regarding our charges, we would wish to resolve any such concerns through discussions with you. However, you may be entitled to have our charges reviewed by the Court. The procedure for doing so is set out in Part III of the Solicitors Act 1974. You should be aware that there are strict time limits applicable to this procedure and you may therefore wish to seek independent legal advice. Winter & Co may also be entitled to charge interest on any outstanding sums from any invoices that are unpaid in full or part.

Professional Indemnity Insurance

In England and Wales we are required to have in place professional indemnity insurance. Details of Winter & Co Solicitors LLP's compulsory professional indemnity insurance as required by the SRA in England & Wales is as follows: we maintain compulsory professional indemnity insurance with Allianz Global & Corporate Specialty SE of 60 Gracechurch Street, London EC3V 0HR. This insurance covers all of our practice which is carried on from our office and will extend to acts or omissions wherever in the world they occur.

Money Laundering

The law requires solicitors to obtain satisfactory evidence as to the identity of their clients and sometimes people related to them. This is because solicitors who deal with money and property on behalf of their client can be used by criminals wanting to launder money.

To comply with the law, Winter & Co needs to obtain evidence of your identity as soon as possible. We will write to you specifying the identification we require. If you cannot provide us with the identification requested, please contact us as soon as possible to discuss other ways to verify your identity. If satisfactory evidence or information is not provided within a reasonable time of our request we may have to stop acting for you.
